These Terms of Use describe the rules for using axii.ai, submitting a request for access, and using any early access or pilot version of Axii provided by Aguilar Technologies Inc. (Axii, we, us). By accessing the site, submitting a request, or using Axii, you agree to these Terms. If you use Axii on behalf of an organization, you represent that you are authorized to accept these Terms for that organization. A separate signed agreement will control if it expressly conflicts with these Terms.

Axii is currently available by request, invitation, or approved pilot only. You agree to provide accurate professional information and to keep any account credentials confidential. We may approve, deny, limit, suspend, or terminate access if information is inaccurate, if use creates risk, if these Terms are violated, or for product and business reasons while Axii remains in early access.

You retain ownership of draft text, documents, audience settings, workspace metadata, and other content you submit to Axii. You grant Axii a limited permission to access, process, transmit, store, and use that content to provide requested analysis, operate and secure the service, troubleshoot issues, and improve product functionality. You represent that you have the rights needed to submit the content, and you should not submit highly sensitive personal information, protected health information, financial account details, classified materials, or similar regulated content unless we have agreed to that in writing.

Axii outputs are probabilistic and informational. They may include modeled audience reactions, summaries, suggestions, or other generated material, but they are not polling results, market research findings, legal advice, compliance advice, or guarantees about how any real person or group will respond. You are responsible for human review, fact checking, legal and professional compliance, publication decisions, and the final content you choose to use.

You may use Axii only for lawful professional purposes. You may not use Axii to violate laws or third-party rights, submit malware or harmful code, probe or bypass security controls, scrape or extract data without permission, deceptively impersonate people or organizations, attempt to identify private individuals from modeled audiences, enable unlawful discrimination, or rely on Axii as the sole basis for employment, credit, housing, legal, healthcare, electoral, or other high-stakes decisions.

Axii may use or connect with third-party services, including Formspree for request-access submissions, hosting and infrastructure providers, security tools, email or CRM tools, analytics providers, AI or model providers, and integrations with platforms such as Google Docs or Microsoft Office. Your use of third-party services may be governed by their own terms and privacy policies. Axii is not responsible for third-party platforms, services, outages, data practices, or content outside our control.

Axii and its licensors own the website, product, software, workflows, designs, models, documentation, branding, and other Axii materials. Except for the limited right to use Axii as made available to you, no rights are transferred to you. You may not copy, modify, reverse engineer, resell, sublicense, or provide Axii as a service bureau or outsourced service. If you provide feedback or suggestions, we may use them without restriction or obligation to you.

Axii is an early-stage service. We may change, pause, discontinue, throttle, or limit any part of the website or service, including features, models, workflows, integrations, and access levels. We may suspend or terminate access to address security, legal, product, or business risks. We do not provide an uptime or availability commitment unless a separate signed agreement says otherwise.

Axii is provided as is and as available. To the extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, uninterrupted operation, and error-free operation. To the extent permitted by law, Axii will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our total liability for claims related to the site or service will not exceed the greater of the amounts paid to Axii for the service in the three months before the claim or $100, except where the law does not allow that limitation.

We may update these Terms by posting a revised version with a new last-updated date. Your continued use of the site or service after an update means you accept the revised Terms. Unless a separate agreement says otherwise, these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules.
